Terms and Conditions

All the fine print for classes, payments & memberships

General Terms & Conditions 

The Introductory Offer is valid for 14 days from date of first booking and is available for clients to purchase one time only. The introductory offer is non-refundable nor transferrable and will activate from the date of your first class booking. Clients found to be buying the introductory offer under another email address or name will be suspended and charged for any additional class costs they may have incurred.

A minimum of 2 people booked into a Reformer Pilates, Mat Flow, Mat Power or Mat Box Strength class is required to proceed and a minimum of 3 people booked into a Yoga style class is required to proceed. You will be contacted via text before 8pm the evening prior for the morning classes and 2 hours prior to the start time for the evening classes if the class is cancelled due to insufficient numbers. If you have booked with a Class Pack, your session will be refunded back to your account. There will be no fees charged to membership holders.

 

Cancellations made less than 9 hours prior to the class start time will forfeit the session if booked with a Class Pack. No-shows and absences at class will forfeit the session. Membership clients will incur a $5 cancellation fee for late cancellations made within 9 hours of the class start time. Membership clients will incur a $15 no-show fee if you do not attend the class.

 

Payment must be made prior to booking. To book into a class you must download the Momence app, pre-purchase session/s in your account and secure your spot in class.

 

Owners and/or instructors reserve the right to restrict clients to a particular class type for safety reasons, and owners and/or instructors reserve the right to turn clients away if they do not have the correct medical clearance. A dated letter from your medical practitioner will suffice.

 

If a class you would like to attend is full, you can sign up to the waitlist. Should a place become available, you will receive a text message from Momence advising a place has become available. You have 10 minutes to reply if you would like to be bumped into the class. If you do not reply, the available place will be offered to the next person on the waitlist. You are under no obligation to take a waitlisted offer. If you are no longer available for the class, remove yourself from the waitlist in advance.

 

Each Class Pack is valid for the following period:

  • Introductory Offer – 14 days (from date of first booking)

  • 5 Class Pack – 3 months (from date of purchase)

  • 10 Class Pack – 3 months (from date of purchase)

  • 15 Class Pack – 6 months (from date of purchase)

  • 25 Class Pack – 6 months (from date of purchase)

  • 50 Class Pack – 12 months (from date of purchase)

These expiry dates apply to both the Reformer and Mat Class Packs.

 

Sessions are non-refundable, non-transferrable and can be extended if you are injured, in which case we will request a medical certificate. Extensions due to medical reasons must be requested before the expiry date.

Foundation memberships payments will automatically continue to process weekly until an email request has been sent through to request to cancel membership.     

 

Weekly Membership is a lock in contract for a minimum of three months. To exit the membership prior to the three months end date, you will be required to pay the remainder of the three month membership on cancellation. Payments will automatically continue to process weekly after three months until an email request has been sent through to request to cancel.

 

Sol Bod Mat Membership is a lock in contract for a minimum of 12 weeks. To exit the membership prior to the 12-week end date, you will be required to pay the remainder of the 12-week membership on cancellation. Payments will automatically continue to process weekly after 12 weeks until an email request has been sent through to request to cancel.

 

Sol Bod Reformer Membership is a lock in contract for a minimum of 12 weeks. To exit the membership prior to the 12-week end date, you will be required to pay the remainder of the 12-week membership on cancellation. Payments will automatically continue to process weekly after 12 weeks until an email request has been sent through to request to cancel.

 

Sol Bod Elite Membership is a lock in contract for a minimum of 12 weeks. To exit the membership prior to the 12-week end date, you will be required to pay the remainder of the 12-week membership on cancellation. Payments will automatically continue to process weekly after 12 weeks until an email request has been sent through to request to cancel.

 

Sessions are non-transferrable to another individual and cannot be used by another person. If someone other than the person booked into the class arrives to use the session, they will be asked to create an account and purchase their own sessions.

 

Gift Cards and Vouchers can be used for all classes and products at Sol Bod Movement. They are not redeemable for cash and are non-transferrable. Sol Bod Movement does not offer refunds, transfers, suspensions or extensions on Gift Cards for change of mind or change of address. Extensions can be applied if a medical certificate is provided. All purchases are final and in accordance with the Australian Competition and Consumer Commission.

 

Class Cancellation Policy

Members are required to cancel their class at least 9 hours prior to the session start time. If the session is cancelled within 9 hours of the session start time the below conditions will apply.

CLASS PACK MEMBERS

  • No shows, absences and late cancellations will forfeit a session.

UNLIMITED MEMBERSHIPS

  • No shows will incur a $15 fee. No-show fees are charged to the card or bank account details on file 24-hours after the missed class start time.

  • Late cancellations will incur a $5 fee. Late cancellation fees are charged to the card or bank account details on file at the time of cancellation.

 

Transaction Fees​

Transaction fees apply on all transactions via the Momence app and website.

  • Credit/debit card - 30c + 2.7% transaction fee.

  • Direct debit - 30c + 2% transaction fee.
     

Membership Terms & Conditions  

​

  1. All memberships operate on a 7-day autopay schedule from the credit card or direct debit details stored in Momence (a secure system). Payment will continue unless notified (see membership termination policy below).

  2. Memberships will continue with scheduled autopay unless Sol Bod Movement is notified of a termination request in writing (see membership termination policy below).

  3. Memberships may be subject to a price increase, but will be communicated in writing 4 weeks prior to any change.

  4. On failed payments the membership will be placed on hold and members will not be able to book. The failed membership charge will automatically retry 24 hours and if failed again, at 48 hours from the initial payment via the Momence account.​ On the third attempt, if payment is not received, the membership will be terminated. If terminated within the 12-week contract, the Owner will contact the member to pay out the remainder of the membership.

 

MEMBERSHIP SUSPENSIONS

Sol Bod Movement requires at least one weeks written notice for memberships to be suspended.

Suspensions are limited to 6 weeks, however each suspension will be assessed case by case. Email request to hello@solbodmovement.com.au.

 

MEMBERSHIP TERMINATION

Sol Bod Movement requires at least two weeks written notice for membership terminations. Email request to hello@solbodmovement.com.au.

In the case of long term or permanent injury or illness that prevents the use of our services, immediate membership termination will be permitted. Termination will take effect from the date we receive written documentation from a medical doctor.

Sol Bod Movement may terminate a membership at any time and without notice if the member is inappropriate, portrays offensive or illegal behaviour on our premise or towards our staff.

If a member wishes to terminate their membership prior to the contract end date, the remainder of the membership will need to be paid out in full.

 

Refund Policy 

Refunds will only be given in line with the Australian Consumer Law.  

We will not provide a refund due to a change of mind.  

Nothing in these terms and conditions shall limit, restrict or exclude any consumer guarantees under the Australian Consumer Law. 

 

Pre-Natal

We do not recommend starting group fitness Pilates for the first time during your pregnancy. We suggest starting with 3 x private Pilates sessions as these exercise programs can be tailored to suit your needs. 

If you have participated in a group fitness Pilates class prior to your pregnancy, we suggest you attend our Reformer Flow classes as this style of class is slower and can be modified to suit prenatal guidelines.  

Doctors’ approval is required for high-risk pregnancies. Ensure your instructor is informed at what week you are at the beginning of each class, as modifications of certain exercises will need to be given.

Post-Natal

Every mother’s postpartum experience is unique. After your 6-8 week postnatal check up with your GP or Obstetrician, you can begin to ease yourself back into classes with written clearance to be emailed to hello@solbodmovement.com.au.

Challenge Policy

For a current member to participate in a challenge, the member is required to pay a sign up fee only. This fee will be determined by the inclusions within the challenge and payment will be required prior to the challenge commencing.

For a credit pack holder to participate in a challenge, the client's current credit pack will be placed on hold and expiry extended by the same duration as the challenge. The fee of the challenge will be determined by the inclusions within the challenge and payment will be required prior to the challenge commencing. 

For new clients wanting to participate in the challenge, the client will be required to create an account with Glofox and pay prior to the challenge commencing.

Private Sessions

Thirty (30) or forty-five (45) minute private sessions available and need to be booked at least one day in advance via our website or Momence app. Bookings are available outside of our group fitness classes. Copies of our Terms and Conditions and Waiver forms will be emailed prior to your initial session and will need to be signed before the first session. 

Client(s) will go through a thorough assessment in their initial consultation to identify any injuries and movement restrictions.
